Email Marketing Laws
Also laws are vary for different countries, but all of them stand against:
- Spam
- Illigal mailing lists
First there is the United States Law which is known by The CAN-SPAM Act
This law limits the use of misleading information in the mail header for commercial emails.
The CAN-SPAM Act states that:
- One should refrain from using a subject line that decieves customers, and provide them with a way to opt-out of the emails.
Next is Canada: The CASL Canada’s Anti-Spam Legislation, it follows similar rules as CAN-SPAM and it states that:
- Sending emails to consumers need their permissions, and the messages being sent ought to be clear.
Next we have the UK: GDPR Regulations, Privacy & electronic regulations.

ALARM! Marking an email as SPAM is so dangerous for your business
Here, a very important role of an email marketing specialist is to not let your email go to the spam folder.
Because that spam notification will be sent to the mail server.
For example, I’m using my Gmail Id and I received an email from Muscan, from [email protected]
If I don’t like the email sent by Muscan, I click on the spam button for that email, It means that when I click on the spam, I’m notifying my Gmail mail server, that the emails coming from this email ID and domain name are not suitable for me, it’s some kind of bullying, fishing, etc., whatever you call it, but I am trying to say it’s not important for me. So, when I enter your email ID, [email protected], into Gmail’s mail server database, that email is registered as a spam email ID and a domain name.
That’s mean:
- The domain reputation will be spoiled if a large number of people (8% of subscribers) mark your email, a high possibility that your email will be in the spam folder. Because on the Gmail server, it has been notified as a spam email ID.
- And if your domain gets more spam IDs, It is almost impossible to bring out your domain name from the bad reputation of any mail server.
So the thumb rule is:
Do not try to send any email without people’s consent or permission, otherwise, your domain reputation will go for a toss and your email quality will decline over time. So to avoid people marketing your email as spam, the better strategy of an email marketing specialist is:
Give them the obvious option of unsubscribing.
